These Terms and Conditions (“Terms”) govern your access to and use of our websites, services, accounts, content, features, text messaging programs, and the purchase of products and services from us (collectively, the “Services”).
By accessing or using the Services, including by browsing the website, creating an account, submitting content, enrolling in SMS, or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility and Permitted Use
You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to use the Services or make a purchase. By using the Services, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.
You may use the Services only for lawful purposes and in compliance with these Terms. You may not use the Services in any way that:
- violates any applicable law, regulation, or third-party right;
- interferes with the operation or security of the Services;
- attempts to gain unauthorized access to accounts, systems, or data;
- uses bots, scrapers, data-mining tools, or similar automated means without our prior written consent;
- posts or transmits unlawful, infringing, defamatory, obscene, fraudulent, or harmful material; or
- impersonates another person or misrepresents your affiliation with any person or entity.
We may suspend or terminate access to the Services at any time if we believe you have violated these Terms or applicable law.
2. Changes to These Terms
We may update these Terms from time to time in our sole discretion. The “Last Updated” date at the top of these Terms indicates when the latest changes were made. Your continued use of the Services after updated Terms are posted constitutes your acceptance of the revised Terms.
3. Accounts and Account Security
You may be required to create an account to access certain features or make purchases. You are responsible for:
- maintaining the confidentiality of your login credentials;
- restricting access to your account and devices;
- ensuring that your account information remains accurate and current; and
- all activity occurring under your account.
You agree to notify us promptly of any unauthorized access to or use of your account. We reserve the right to refuse service, restrict access, suspend accounts, or cancel accounts at our discretion.
4. Product Information, Pricing, and Availability
We strive to present accurate product descriptions, pricing, imagery, availability, specifications, and other content. However, errors, inaccuracies, omissions, delays, and typographical mistakes may occur.
We do not guarantee that product descriptions, pricing, availability, images, dimensions, compatibility information, or other content is accurate, complete, reliable, current, or error-free. Colors and appearance may vary depending on your screen or device.
All prices, promotions, inventory, and product availability are subject to change without notice. We reserve the right to correct errors and to revoke any stated offer resulting from an error, inaccuracy, or omission.
5. Orders; Acceptance; Refusal; Cancellation
Your submission of an order is an offer to purchase. We may accept, reject, limit, or cancel any order in our sole discretion, including after an order confirmation has been sent.
We reserve the right to refuse or cancel orders for reasons including, without limitation:
- product unavailability;
- pricing or listing errors;
- suspected fraud or unauthorized activity;
- issues verifying payment information;
- suspected resale, diversion, or abuse;
- legal or regulatory restrictions; or
- inaccuracies in shipping, age, identity, or compliance information.
If we cancel an order after payment has been authorized or captured, we will issue a refund in accordance with our internal procedures and applicable law.
6. Payment Terms
You agree to provide current, complete, and accurate payment and billing information. By submitting payment information, you represent and warrant that you are authorized to use the payment method provided.
We may use third-party payment processors, and your payment may be subject to their terms and privacy practices. We are not responsible for errors caused by third-party payment providers.
Applicable taxes, shipping charges, carrier surcharges, compliance fees, and other disclosed charges may be added to your order where appropriate.
7. Shipping, Delivery, Pickup, and Risk of Loss
Shipping and delivery dates are estimates only and are not guaranteed unless expressly stated otherwise. Delays may occur due to carrier issues, weather, inventory constraints, compliance reviews, or other circumstances outside our control.
Risk of loss and title pass to you in accordance with applicable law and the shipping terms associated with your order. For pickup orders, risk of loss may pass upon tender of the goods to you or your authorized pickup recipient, subject to applicable law.
You are responsible for inspecting delivered or picked-up items promptly and notifying us within a reasonable time of any issue.
8. Returns, Exchanges, Refunds, and Final Sale Items
Your purchase may be subject to our posted return, exchange, refund, cancellation, restocking, and final-sale policies, as updated from time to time. Those policies are incorporated into these Terms by reference.
Unless otherwise required by law or expressly stated in a specific policy or promotion:
- sale items, clearance items, customized items, and certain regulated items may be final sale;
- shipping charges may be nonrefundable;
- returns may be denied if items are worn, altered, damaged, incomplete, or returned outside the applicable return window; and
- refund timing may vary depending on the payment provider and method used.
9. Firearms, Ammunition, Restricted Products, and Legal Compliance
Certain products sold or referenced through our Services may be subject to federal, state, and local legal restrictions, including age, licensing, transfer, shipping, pickup, storage, and possession requirements.
By ordering any regulated or restricted product, you represent and warrant that:
- you are legally eligible to purchase, receive, possess, and use the product;
- you will comply with all applicable laws and transfer requirements;
- all information you provide for compliance screening is truthful and complete; and
- you understand that certain products may require additional review, age verification, identity verification, transfer to a licensed dealer, in-store pickup restrictions, or order cancellation.
We reserve the right to refuse or cancel any order involving regulated products if compliance cannot be verified to our satisfaction.
10. Promotions, Discounts, Sweepstakes, and Contests
We may offer promotions, discount codes, loyalty benefits, contests, sweepstakes, giveaways, or limited-time offers from time to time. Such offers are subject to these Terms plus any additional terms, rules, eligibility requirements, or restrictions provided with the offer.
We reserve the right to modify, suspend, cancel, or revoke any promotion or discount at any time, including where we suspect fraud, abuse, technical error, or violation of promotional terms.
11. Reviews, Ratings, User Content, and Feedback
If you submit a review, rating, testimonial, comment, photo, video, suggestion, idea, or other content (“User Content”), you grant Simpson a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, display, publish, adapt, modify, distribute, and otherwise exploit that User Content in any media for business purposes, subject to applicable law.
You represent and warrant that your User Content:
- is truthful and based on your actual experience where presented as a review or testimonial;
- does not violate any law or third-party right;
- is not false, misleading, defamatory, obscene, abusive, or infringing;
- does not include confidential information or sensitive personal data of others; and
- complies with any review, community, or submission guidelines we provide.
We may remove, refuse, moderate, or investigate User Content at our discretion.
Nothing in these Terms prohibits you from posting honest reviews or opinions about our products or services. However, fake reviews, misleading testimonials, review manipulation, undisclosed insider reviews, and similar deceptive practices are prohibited. The FTC’s Consumer Reviews and Testimonials Rule has prohibited a range of deceptive review practices since October 21, 2024.
12. Intellectual Property
All content on the Services, including text, graphics, logos, icons, images, audio, video, software, page layouts, and compilations, is owned by Simpson or its licensors and is protected by copyright, trademark, trade dress, and other applicable laws.
Except as expressly allowed in writing, you may not copy, reproduce, republish, upload, post, transmit, distribute, display, modify, reverse engineer, create derivative works from, or exploit any part of the Services or their content.
All trademarks, service marks, logos, and trade names displayed on the Services are the property of their respective owners. No license or right is granted to you by implication, estoppel, or otherwise.
13. Copyright Complaints
If you believe content on the Services infringes your copyright, contact us with reasonably detailed information sufficient for us to review your claim, including identification of the allegedly infringing material and proof of ownership or authority to act on behalf of the owner.
14. Third-Party Links and Services
The Services may contain links to third-party websites, applications, content, or services. We provide those links for convenience only and do not control, endorse, or assume responsibility for any third-party content, products, services, terms, or privacy practices.
Your use of third-party services is at your own risk and subject to the applicable third party’s terms and policies.
15. Privacy
Your use of the Services is also subject to our Privacy Policy, which describes how we collect, use, disclose, and protect personal information.
16. Mobile Messaging (SMS/MMS) Terms
We may offer one or more SMS or MMS programs for promotional messages, cart reminders, order updates, customer care, account alerts, and similar communications.
By opting in through a form, checkout box, keyword text, account setting, or other consent mechanism, you agree to receive recurring autodialed or manually sent marketing or transactional text messages from us at the mobile number you provide, to the extent permitted by law. Consent is not a condition of purchase.
You represent that you are the authorized user of the mobile number provided and that you are authorized to consent to receive messages at that number.
Message frequency varies. Message and data rates may apply. Supported carriers may change without notice. Carriers are not liable for delayed or undelivered messages.
You may opt out at any time by texting STOP in response to a message or by using another reasonable method made available by us. You may receive a final confirmation message. Current FCC rules recognize that consumers may revoke prior express consent by any reasonable method that clearly expresses a desire not to receive further calls or texts.

We may suspend or terminate messaging programs at any time. We may also change any short code, toll-free number, sending number, or message terms.
To the extent your prior SMS language referenced the FCC’s one-to-one consent rule, that rule was partially vacated by the Eleventh Circuit in January 2025, so this update avoids locking your Terms to that invalidated standard.
17. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES, ALL CONTENT, AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMPSON DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMPSON AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS INTERRUPTION, OR DIMINUTION IN VALUE, ARISING OUT OF OR RELATING TO THE SERVICES, ANY PRODUCT, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES, ANY PRODUCT, OR THESE TERMS SHALL NOT EXCEED THE GREATER OF:
(a) THE AMOUNT YOU PAID TO US FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
(b) ONE HUNDRED U.S. DOLLARS ($100.00).
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
19. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Simpson and its affiliates, officers, directors, employees, contractors, agents, licensors, successors, and assigns from and against any claims, actions, liabilities, losses, damages, judgments, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:
- your use of the Services;
- your breach of these Terms;
- your violation of any law or third-party right;
- your User Content; or
- your misuse of any product purchased through the Services.
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with that defense.
20. Dispute Resolution; Arbitration; Class Action Waiver
Please read this section carefully. It affects your legal rights.
A. Governing law
These Terms and any dispute arising out of or relating to the Services, any purchase, or these Terms will be governed by the laws of the State of South Carolina, without regard to conflict-of-law principles, except to the extent preempted by federal law.
B. Agreement to arbitrate
Except for disputes that qualify for small claims court, and except for claims seeking injunctive relief for misuse of intellectual property or unauthorized access to the Services, you and Simpson agree that any dispute, claim, or controversy arising out of or relating to the Services, any purchase, these Terms, or the relationship between you and Simpson shall be resolved by final and binding arbitration on an individual basis.
C. Informal resolution first
Before starting arbitration, the party bringing the dispute must send written notice describing the claim and requested relief. The parties agree to attempt to resolve the matter informally for at least 30 days before arbitration is filed.
D. Arbitration procedure
If the dispute is not resolved informally, the arbitration shall be administered by a recognized arbitration provider under its applicable consumer rules, as modified by these Terms. The arbitration may be conducted in South Carolina unless otherwise required by the arbitration rules or applicable law. Judgment on the award may be entered in any court of competent jurisdiction.
E. No class actions or representative proceedings
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND SIMPSON AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF, CLAIMANT, OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING.
F. Jury trial waiver
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND SIMPSON WAIVE ANY RIGHT TO A JURY TRIAL FOR ANY DISPUTE PERMITTED TO PROCEED IN COURT.
If the class action waiver is found unenforceable in a given case, then the relevant class or representative claims must proceed in a court of competent jurisdiction and not in arbitration.
21. Electronic Communications and E-Sign Consent
By using the Services, creating an account, or placing an order, you consent to receive communications from us electronically, including by email, website posting, account notification, and where applicable SMS. You agree that electronic communications, disclosures, notices, and records satisfy any legal requirement that such communications be in writing.
22. International Use
The Services are intended for use in the United States. We make no representation that the Services are appropriate or available outside the United States. If you access the Services from outside the United States, you do so at your own risk and are responsible for compliance with local laws.
23. Termination
We may suspend, limit, or terminate your access to the Services at any time, with or without notice, for any reason, including suspected fraud, misuse, legal risk, or violation of these Terms.
The following sections will survive termination to the extent applicable: Intellectual Property, Reviews/User Content license, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, Governing Law, and any other provisions that by their nature should survive.
24. Severability; Waiver; Assignment
If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by law.
Our failure to enforce any provision of these Terms will not constitute a waiver of that provision or any other provision.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
25. Entire Agreement
These Terms, together with our Privacy Policy and any additional posted policies or terms expressly incorporated by reference, constitute the entire agreement between you and Simpson regarding the Services and supersede prior or contemporaneous understandings relating to the same subject matter.
